These Terms of Use (“Terms”) govern access to the website Dynwybeautex.world operated from the Netherlands. By using the site, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the website.

2. Nature of the service

The website publishes general lifestyle information about office movement, desk exercises, posture breaks, and related wellbeing topics. Content is for education only. It is not medical, psychological, therapeutic, or occupational-health advice, and does not establish a clinician–patient or therapist–client relationship. Always consult qualified professionals for decisions about your health. You use the information at your own responsibility.

Nothing on this site is intended to diagnose, treat, or prevent any condition. See the disclaimer displayed on each page.

3. Availability and changes

We aim to keep the website available but do not guarantee uninterrupted access. Maintenance, updates, or force majeure may cause temporary unavailability. We may change, add, or remove content and features without prior notice, except where mandatory law requires otherwise.

6. Events, bookings, and consumer information (Netherlands)

Event dates and formats on the site are indicative and may change. Submitting the contact form does not create a binding contract until we confirm your booking in writing (usually by email).

Consumers in the EU/Netherlands: Where the Dutch Civil Code (Burgerlijk Wetboek) and EU consumer rules grant a statutory herroepingsrecht (cooling-off period), we inform you in the confirmation email whether it applies. For leisure services on a fixed date (e.g. a scheduled group class), Article 6:230p BW may exclude the right of withdrawal; we still set out fair cancellation terms before payment. Website guides remain free; only separately confirmed sessions may be paid.

8. Limitation of liability

To the fullest extent permitted under Netherlands law:

Consumers: If you qualify as a consumer under the Dutch Civil Code (Burgerlijk Wetboek), you benefit from mandatory protections that cannot be waived by these Terms, including rules on unfair terms (Articles 6:233 and following BW) and consumer rights under EU implementations in the Netherlands.

Our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation is not limited.

9. Third-party services and links

Embedded tools (e.g. Google Maps) and external links are provided for convenience. We do not control third-party content or policies. Your use of those services is subject to the provider’s terms and privacy notices.

10. Complaints and dispute resolution

Please contact us first at talk@dynwybeautex.world with any complaint; we will endeavour to respond within a reasonable time (typically 14 days).

EU consumers may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr. We are not obliged to participate in a consumer arbitration board unless required by law for a specific service.

Data protection complaints may be lodged with the Autoriteit Persoonsgegevens (see Privacy Policy).

11. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules that would refer to another country’s law.

Disputes are submitted to the competent court in the Netherlands, subject to mandatory rights of consumers to bring proceedings in their country of residence under EU Regulation 1215/2012 (Brussels I recast) where applicable.

For business users without mandatory consumer protection, the courts of the district of Utrecht shall have exclusive jurisdiction unless otherwise required by imperative law.

12. Severability and entire agreement

If any provision is held invalid, the remaining provisions stay in effect. These Terms, together with the Privacy and Cookie Policies, constitute the entire agreement regarding website use unless separate written terms apply to a specific paid service.

13. Changes

We may amend these Terms. The updated version is effective when published with a new “Last updated” date. Continued use after changes constitutes acceptance where permitted by law; for material changes affecting consumers we will provide clear notice on the site.
